SplashTiles Cloud customer agreement

This Customer Agreement (this “Agreement”) contains the terms and conditions that govern your access to and use of the Service Offerings (SplashTiles Cloud and SplashTiles Cloud API) and is an agreement between Video Storm LLC (““we,” “us,” or “our”) and you or the entity you represent (“you” or “your”). This Agreement takes effect when you click an “I Accept” button or check box presented with these terms or, if earlier, when you use any of the Service Offerings (the “Effective Date”). You represent to us that you are lawfully able to enter into contracts (e.g., you are not a minor). If you are entering into this Agreement for an entity, such as the company you work for, you represent to us that you have legal authority to bind that entity.

Acceptable Use of Service

SplashTiles Cloud service is intended to be used by a single person, household, or company for the display of the custom Screens created or imported by that user.
Your SplashTiles Cloud membership is non transferrable. Your membership may not be transferred or sold to another party.
SplashTiles Cloud API is intended to be solely used for the control and status monitoring of registered SplashTiles apps on devices purchased by you.

The following actions are strictly forbidden:
1. Attempting to access other users accounts, data, or systems
2. Attempting to access any data not associated with your user account
3. Storing copyright material, illegal data, or pornography in your SplashTiles Cloud account
4. Using any method to circumvent our page view or registered device limits

Video Storm LLC reserves the right to pursue legal action against you if your unacceptable use of the Service results in financial harm or business disruption. You acknowledge that it is your responsibility to follow the terms of this agreement.

Page view limits

SplashTiles Lite accounts have a monthly page view limit which tracks the number of server api accesses from each of your devices. You can view your current usage on the Devices page. If you exceed the monthly limit, your pages will include Ads untill the start of the next month.
SplashTiles Pro accounts have unlimited page views, but they are still subject to device limits and reasonable use of the api. If you are using more devices than you have on your account, your access may be limited. A very high number of page views may also result in limitations. Please contact our support if your account is limited by our automated system.

Account Termination

Your account and right to use SplashTiles Cloud can be terminated by Video Storm LLC at any time and for any reason. Generally this will only occur if you violate the terms of this agreement. However, termination is at the sole discretion of Video Storm LLC and may not be challenged in any manner.

Video Storm also reserves the right to discontinue the SplashTiles Cloud at its discretion. We make no guarantees regarding service availability or continuation.

Fees

SplashTiles Cloud is currently offered as a premium paid service to you. We reserve the right to change our pricing should we deem it necessary. If we elect to change our pricing, you will have the opportunity to cancel your account prior to your next billing cycle.

Copyrights

Storing your data on SplashTiles Cloud immediately grants Video Storm LLC the right to use that data in whatever manner they choose. Video Storm LLC makes no guarantees about your ability to retrieve or access any data stored on SplashTiles Cloud.

Security

SplashTiles Cloud is a service which allows control and status monitoring of your home electronics and network from the internet. SplashTiles Cloud uses commercially acceptable methods to prevent unauthorized access to your account, devices, or home network. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security. You agree to release Video Storm LLC from all liability regarding unauthorized use or access to your account or connected devices, regardless of how such use occurs.
