By purchasing or using Video Storm LLC website, products, or services, you agree and accept all terms, conditions, and policies on this page. These terms and conditions constitute a binding legal agreement between you and Video Storm LLC. All purchases are subject to approval by Video Storm LLC. Video Storm LLC reserves the right to refuse sales and/or service to anyone or terminate your account without cause at any time. If you do not agree to these terms and conditions, you may not purchase Video Storm LLC products or services, nor use this website.

Referral Program

The SplashTiles Referral program is a promotional marketing program conditionally available to SplashTiles Pro customers. Video Storm reserves the right to cancel or change the program at any time and for any reason. Customers can earn promotional store credit toward their SplashTiles Pro subscription by using the provided referral links to sign up new SplashTiles customers. Promotional credit is provided once the new customer completes the SplashTiles Pro trial period and pays for service. The amount of credit earned varies. Please contact sales@video-storm.com for the current rates. SplashTiles referral links may not be used in any type of spam marketing. Promotional credit is contingent on Video Storm being paid for the new customers service. Any payment cancellation, fraud, errors, or other event preventing or refunding payment will also cancel the promotional credit. Referral credits cannot be combined with any other promotions.

Return Policy

When you receive your shipment, immediately inspect the package for shipping damage. While it is extremely rare for shipping damage to occur, if your package is damaged, notify the shipping company AND Video Storm LLC of the damage within 2 days. If shipping insurance has been purchased, you will be reimbursed by the shipping company for the damaged item. However, it is your responsibility to notify both parties within 2 days of receiving the damaged item.

If you decide you need to return a product (not damaged in shipping), you will need to request an RMA and receive a RMA number from Video Storm LLC. No returns will be accepted without an official RMA number. An RMA can be requested up to 30 days from the purchase date, and the original product must be received in new condition within 10 days of the RMA receipt. If you purchased a Video Storm product through a dealer, please contact that dealer to understand their return policies.

Items can be returned only if in original packaging, same new condition as sold with power supplies and accessories. Please ship the items back to us prepaid. For your protection, make sure to insure the package. Video Storm LLC cannot be responsible for lost or damaged packages. There is a 10% reconditioning fee plus any refurbishing fees. If anything is incomplete or damaged on the returned product, the replacement or repair will be deducted from the refund. Shipping charges are not refundable. You are responsible for the accuracy and completeness of your billing/shipping addresses. Please double check your receipt to verify after checkout If packages delivered are refused by the customer, shipping, reroute, and restocking charges will not be refunded. Returned packages will incur a $20 processing fee plus reroute and reshipping fees.

Software licenses are non returnable and non refundable.

SplashTiles Cloud membership is free for the first 14 days (the Trial Period). After the Trial Period ends, your credit card will be charged per your billing cycle. If your membership is cancelled at any time after the Trial Period, all membership fees already paid will not be refunded. Your account will not incur any additional charges after cancellation.

International Shipping

When using the "Flat Rate" shipping method for international delivery, tracking is only available to a limited number of countries. If you choose this service, you will only receive tracking updates until the package leaves the United States. You accept full responsiblity for loss of the package when using "Flat Rate" service. Choose our UPS delivery method if you need complete door to door tracking with insurance.

Customers are directly responsible for international duties and taxes which are not refundable. If customer refuses to pay duties and taxes, Video Storm LLC reserves the right to charge the full amount plus processing fees to the customer's credit card. Customer is fully responsible for loss, rerouting fees, and processing fees on refused and returned packages.

Warranties

Video Storm LLC warranty covers parts and labor for 1 or 3 years following original purchase order (see specific product details for duration). Products sold as "refurbished" have a 90 day warranty. External components such as wall power supplies/adapters and IR flashers have a 30 day warranty. In the unlikely event you receive an item that was not damaged in shipping but is defective please contact us within 7 days and we will provide refundable advance replacement promptly via ground shipping for domestic orders only. Warranty covers all manufacturing defects. Electrical, water, physical, or other incurred damages and costs are not covered. Tampering with serial numbers will void your warranty. You must provide original proof of purchase to obtain warranty service. Replacement parts have a warranty term which is the longer of either 30 days or the warranty term from date of original purchase order.

SplashTiles Cloud service has no warranties.

Except as expressly stated in this agreement, Video Storm LLC expressly disclaims and negates any implied or express warranty of merchantability, any implied or express warranty of fitness for a particular purpose, and any implied or express warranty of conformity to all products.

Video Storm LLC makes no representation as to the completeness, accuracy or currentness of any information on this website, and undertakes no obligation to update or revise the information contained on this website, whether as a result of new information, future events or circumstances or otherwise. It is your responsibility to verify any information contained in this website before relying upon it. All pricing on the Video Storm LLC website is subject to change at any time. Written product quotes are valid for 30 days, subject to availability. Verbal quotes are non binding. Any forward looking statements contained on this website or given by Video Storm LLC officers, directors, employees, consultants, agents, and other representatives represent the current expectations of management. These statements are neither promises nor guarantees.

Limitations of Liability

To the fullest extent permitted by law, Video Storm LLC shall not be liable for any damages of any kind arising from or relating to your use of Video Storm LLC products or services including but not limited to loss of business, loss of use or of data, interruption of business, lost profits or goodwill, damage to equipment, cost of procurement of substitute goods or services, or other direct, indirect, special, punitive, incidental, examplary, or consequential damages of any kind, even if Video Storm LLC has been advised of the possiblity of such loss and whether or not Video Storm LLC had any knowledge, actual or constructive, that such damages might be incurred. This exclusion includes any liability that may arise out of third party claims against you. Video Storm LLC does not guarantee the content, functionality, or quality of any third party products or services accessed by our website and/or products. Your sole and exclusive remedy for any dispute in connection with the products or services is to cease your use of the product or service.

You agree to defend, indemnify and hold harmless Video Storm LLC, and its officers, directors, employees, consultants, agents, and other representatives, from and against any and all suits, claims, actions, proceedings, damages, demands, attorney fees, injuries, liabilities, losses, costs, and expenses, arising from or related to: (a) your negligence or willful misconduct; (b) your use of the products and services; (c) your breach of any of your representations, warranties, obligations, or covenants; and (d) your use of third party content.

Governing Law and Jurisdiction

Any claims arising hereunder will be governed by the laws of the State of Colorado. To the extent permitted by applicable law, you and Video Storm LLC hereby irrevocably submit to the jurisdiction of Colorado county and state courts, and you and Video Storm LLC hereby irrevocably agree that all claims with respect to any such suit, action or other proceeding shall be heard and determined in such courts. The parties hereby unconditionally waive their respective rights to a jury trial of any claim or cause of action arising directly or indirectly out of, related to, or in any way connected with the performance or breach of this agreement, and/or the relationship that is being established among them. This waiver is all encompassing of any and all disputes that may be filed in any court or other tribunal (including, without limitation, contract claims, tort claims, breach claims, and all other common law and statutory claims). In the event of litigation, this agreement may be filed as a written consent to a trial by the court.

Miscellaneous

The terms and conditions in this agreement supersede and replace any prior or contemporaneous written or oral statements by Video Storm LLC or its officers, directors, employees, consultants, agents, and other representatives. If any provision of this terms and conditions is held by a court to be invalid or unenforceable under applicable law, such provision will be deemed modified to the extent necessary to render such provision valid and enforceable, and the other provisions will remain in full force and effect.
